MAINE COON KITTEN CONTRACT OF SALE

This Agreement (“Pet Agreement”) is entered into between Upstate Maine Coon (“Seller”) and PURCHASER NAME (“Purchaser”). In consideration of the sum of $AMOUNT (“Purchase Price”), of which $DEPOSIT has been paid as a non-refundable deposit and the remaining balance of $BALANCE is due at or before transfer of possession; Seller grants, conveys, and transfers the following kitten (“Maine Coon Kitten”) to Purchaser.

______ The Seller will not release any kitten to the Purchaser before the age of sixteen (16) weeks. This policy ensures that each kitten is fully weaned, properly socialized, and has received all age-appropriate veterinary care prior to transfer. All kittens leave the cattery fully vaccinated. The Purchaser is expected to pick up the kitten within a two (2) week window once the Seller has notified them that the kitten is ready to go home. Special accommodations may be made for out-of-state or long-distance Purchasers, but such arrangements must be agreed upon in writing prior to pickup.

______ All kittens are microchipped prior to leaving the Seller’s care. The Purchaser agrees that their information shall be listed as the primary contact on the cat’s microchip registration. The Seller’s information shall remain listed as the secondary contact. This requirement is in place to ensure that, in the event the cat becomes lost and the Purchaser cannot be reached, the Seller will be contacted as an additional safeguard. The Purchaser agrees not to remove or alter the Seller’s information from the microchip registration at any point during the cat’s lifetime.

______ The Purchaser agrees that the Kitten shall not be resold, rehomed, leased, gifted, abandoned, surrendered, or transferred under any circumstances to a shelter, pound, pet shop, research laboratory, humane organization, or any similar facility. The Kitten may not be given away to family, friends, or third parties without the express written consent of the Seller. If, at any point during the Kitten’s lifetime, the Purchaser becomes unable or unwilling to care for the Kitten—regardless of the Kitten’s age, health, or circumstances—the Purchaser shall notify the Seller immediately. The Seller reserves the Right of First Refusal, meaning the Kitten must be offered back to the Seller before any rehoming or transfer is considered. The Seller reserves the right to have the Kitten returned to the cattery at the Purchaser’s expense. This policy is in place to ensure that no kitten bred by the Seller is ever abandoned, placed at risk, or left without proper lifelong care.

______ The Seller warrants that the Kitten is fully litter box trained at the time of transfer. However, the Purchaser acknowledges that the stress of transitioning to a new environment may temporarily confuse the Kitten and could result in improper elimination. It is the responsibility of the Purchaser to ensure that the Kitten is properly introduced to the location of its litter box upon arrival in its new home.

______ The Purchaser agrees that the Kitten, and any cat bred from this cattery, shall be kept strictly indoors at all times. The cat shall not be permitted to free-roam outdoors under any circumstance. Limited outdoor access is only permissible if the cat is secured on a harness and leash while accompanied by a responsible adult, or if confined within a secure outdoor enclosure or catio under direct supervision. This condition is established to protect the health, safety, and welfare of the cat, as outdoor free-roaming presents significant risks including but not limited to disease exposure, injury, theft, and premature death. The Purchaser acknowledges that failure to comply with this requirement constitutes a breach of this agreement.

______ Only applicable if being sold as pet; This cat is being sold as a pet only and will be spayed or neutered prior to leaving the Seller’s home. The Purchaser understands and agrees that the cat is not to be used for breeding under any circumstance. Registration papers will reflect a pet-only designation.

______ The Purchaser agrees to provide the Cat with a safe, clean, and healthy living environment. The Cat shall be kept as a household companion and provided with appropriate enrichment, social interaction, and mental stimulation. The Purchaser agrees to ensure the Cat has access to clean water at all times, quality nutrition, and a comfortable, sanitary indoor living space. The Cat shall not be subjected to neglect, hoarding conditions, or any environment that jeopardizes its health, safety, or welfare. The Purchaser further agrees to provide prompt veterinary care in the event of illness, injury, or medical need.

______ The Purchaser agrees to maintain the Cat at a healthy weight and provide a balanced, high-quality diet appropriate for the Maine Coon breed. The Purchaser understands that obesity significantly increases the risk of joint disease, heart conditions, and overall reduced lifespan. The Purchaser shall not feed the Cat low-quality diets or raw food diets unless specifically recommended and supervised by a licensed veterinarian. Proper nutrition and weight management are essential to the Cat’s long-term health and form part of this agreement.

______ The Purchaser agrees to provide the Cat with appropriate veterinary care, including a minimum of one annual physical examination every twelve (12) months by a licensed veterinarian. This shall include all standard vaccinations recommended for feline health until the Cat reaches the age of eight (8) years old, unless otherwise directed by a veterinarian for medical reasons.

______ The Purchaser further agrees to make reasonable efforts to remain in contact with the Seller throughout the Cat’s lifetime, and to notify the Seller of any major health concerns or significant diagnoses that may arise. This communication ensures the Seller remains informed about the long-term health and welfare of cats bred from their cattery.

______ The Purchaser agrees that under no circumstance shall the Kitten be declawed. Declawing is considered an inhumane and harmful procedure that causes permanent damage to the cat. The Seller requires that all kittens and cats bred from this cattery retain their natural claws for their health, safety, and well-being. Any attempt to declaw this Kitten will be considered an immediate breach and termination of this contract, and will void all guarantees contained herein. In addition, the Purchaser agrees to pay the Seller liquidated damages in the amount of $2,000 as compensation for breach of contract, misrepresentation of the Seller’s breeding program, and the irreversible harm caused to the animal. The Seller also reserves the right to demand the immediate return of the Kitten at the Purchaser’s expense, with no refund or replacement provided.

______ The Purchaser agrees that this Cat shall not be euthanized for any reason other than a verified medical emergency in which euthanasia is deemed the most humane course of action by a licensed veterinarian. The Cat shall not be euthanized for behavioral issues, inconvenience, or financial limitations. If the Purchaser becomes unable to provide appropriate care for the Cat, or is unable or unwilling to pay for medical treatment for treatable illnesses, injuries, or conditions, the Purchaser agrees to relinquish the Cat back to the Seller. In such case, the Purchaser shall immediately transfer full ownership of the Cat back to the Seller, surrendering the Cat to the Seller’s care and custody rather than pursuing euthanasia or surrender to any third party, shelter, or rescue.

______ Only Applicable if purchasing for breeding; If the Cat is purchased with breeding rights, the Purchaser agrees that the Cat shall only be bred to registered Maine Coons that are in good health and have been fully tested for genetic and hereditary conditions common to the breed, including but not limited to HCM (Hypertrophic Cardiomyopathy), SMA (Spinal Muscular Atrophy), PKDef (Pyruvate Kinase Deficiency), and Hip Dysplasia.

______ If the Cat is placed into a home where other cats are present, the Purchaser agrees to properly isolate and gradually introduce the Cat over a period of seven (7) to fourteen (14) days. This introduction period is necessary to reduce stress, prevent illness, and ensure safe socialization. The Purchaser shall provide the Cat with its own secure space during the adjustment phase and supervise all initial interactions with existing household pets.

______ This Agreement is a binding legal contract entered into by both the Seller and the Purchaser. The Purchaser acknowledges and agrees that any breach of the terms contained herein shall constitute a material breach of contract. In the event of such breach, the Seller reserves the right to repossess the Cat without refund and/or pursue liquidated damages as specified in this Agreement. The Purchaser shall be responsible for all legal fees, court costs, and associated expenses incurred by the Seller in enforcing the terms of this Agreement. This Agreement shall be governed by and construed under the laws of the State of Tennessee, and any disputes arising from this Agreement shall be resolved in the courts of Meigs County.


HEALTH GUARANTEE

1.) The Seller warrants that the Kitten is being sold in good health at the time of transfer from the Seller’s premises. The Kitten has undergone a comprehensive physical examination by the Seller’s licensed veterinarian prior to leaving, including but not limited to an eye examination, ear examination, and auscultation. The Kitten will be up to date on all age-appropriate vaccinations and has been regularly dewormed in accordance with veterinary guidance. The Seller affirms that, to the best of their knowledge, the Kitten is free from communicable diseases and internal/external parasites at the time of sale. Documentation of the Kitten’s veterinary examination, vaccination history, and deworming schedule shall be provided to the Purchaser at the time of transfer.

2.) The Seller encourages, but does not require, that the Purchaser have the Kitten examined by a licensed veterinarian of their choice within seventy-two (72) hours of receipt (excluding weekends and holidays). If, during this period, the Kitten is found to have a serious health condition that is life-threatening or significantly impairs quality of life, the Purchaser must provide the Seller with a written statement from the examining veterinarian within five (5) business days. In such case, the Kitten may be returned to the Seller and, as soon as a suitable kitten of equal value becomes available, the Purchaser will be provided with a replacement. Cash refunds are not offered under this guarantee. The breeder has the right to request a second opinion from a Veterinarian of the Breeder’s choice, at the Breeder’s expense.

The Seller will not honor any guarantee if the Kitten has contracted or died from a viral or communicable disease obtained through contact with another cat not bred by the Seller’s cattery. Should the Kitten die within the initial seventy-two (72) hour period despite medical treatment, a replacement kitten of equal value will be provided only if a licensed veterinarian certifies the cause of death in writing. The Seller reserves the right to request the return of the Kitten’s body for identification and confirmation prior to providing a replacement.

The Kitten may not be returned to the cattery under this guarantee if it has been exposed to Feline Leukemia Virus (FeLV) or Feline Immunodeficiency Virus (FIV) within the Purchaser’s household, or if it has been in contact with another cat that has not been tested for these diseases in which case the breeder will work with the purchaser to find a suitable home.

3.) There is no guarantees against FIPV, (Feline Infectious Peritonitis Virus), a mutated form of the Feline Coronavirus (FCoV).

4.) The Seller guarantees that the Kitten’s parents have been tested for known hereditary conditions common in the Maine Coon breed, including but not limited to: Hypertrophic Cardiomyopathy (HCM), Spinal Muscular Atrophy (SMA), Pyruvate Kinase Deficiency (PKDef), Hip Dysplasia (evaluated by OFA) The Seller warrants that, to the best of their knowledge, the Kitten is free from hereditary defects at the time of sale. This guarantee extends until the Kitten reaches twelve (12) months of age. If, during this period, the Kitten is diagnosed with a life-threatening or debilitating hereditary condition confirmed in writing by two licensed veterinarians (one of whom must be a specialist in the relevant field), the Kitten may be returned to the Seller. Upon confirmation of the diagnosis, the Purchaser will be provided with a replacement kitten of equal value as soon as one becomes available. Refunds are not offered under this guarantee.

5.) If a cat is sold with breeding rights and is later proven to be permanently sterile (unable to reproduce), the Purchaser must provide written certification from a licensed veterinarian confirming sterility. In such case, the Seller agrees to either: a) Refund the breeding fee (the difference in cost between pet price and breeding price) upon proof of spay/neuter; or b) Accept the return of the cat and provide the Purchaser with a replacement breeding-quality cat of equal value as soon as one becomes available.

6.) This guarantee shall be considered null and void if the Kitten has been bred (without breeding rights), has been neglected, abused, or not provided with proper veterinary care, or if the condition arises as the result of injury, accident, or environmental factors beyond the Seller’s control.
